This website is owned by Xerpa Mobility SL (hereinafter XM). XM operates under the trading name Xerpa Mobility and acts as an agent in providing transport booking services through its websites.

Service description

XM is a value-added intermediary service complementary to the official passenger transport service in the Principality of Andorra. As added value, it provides 365/24 booking management (including modification, cancellation and service adaptation) with 24-hour assistance and online prepayment. Payment for services includes the transport service fee.

These Terms of Service (general terms) govern access to and use of the services provided on this website. Access to and use of these services is conditional on acceptance of and compliance with these terms.

By completing your booking, you confirm that you have read, understood and accepted these terms, and that you have the necessary legal capacity and authority to accept them on your own behalf and/or on behalf of your travelling companions.

Accordingly, you will be responsible for making the appropriate payments, you must notify us of any modification or cancellation, and upon receiving the booking confirmation you must inform the other travellers.

Any communication relating to the contracted service must be sent to the email address indicated in the contact section.

If you do not understand any of the terms set out in this document, please contact our customer service team before entering into this agreement.

Intellectual property rights

The registered trademarks, trade name and other intellectual property rights appearing on our website belong to XM and are protected by national and international industrial and intellectual property regulations.

All content (including texts, layouts, graphics, logos, button icons, images, audio files and software) used on the Xerpa Mobility websites is the property of XM and is protected by national and international industrial and intellectual property regulations. Any use is therefore prohibited, including modification, reproduction or representation in whole or in part without our express written consent.

You therefore undertake not to use our website for unlawful purposes.

Pre-booking information

These General Booking Terms and Conditions shall govern the commercial relationship arising between Xerpa Mobility SL and the user or client for bookings made through the forms provided by XM.

Booking through the Xerpa Mobility websites constitutes express acceptance by the client or user of these terms and conditions, as well as the terms of use established for the user's navigation of pages owned by Xerpa Mobility.

These terms and conditions shall apply without prejudice to the application of any legal regulations on the matter applicable in each case, including the regulations in force in the Principality of Andorra.

XM reserves the right to make such modifications as it deems appropriate, without prior notice, to the General Terms and Conditions. Such modifications may be made through its websites in any legally admissible form and shall be binding for as long as they remain published on the website.

The client expressly declares:

  • To know, understand and accept the terms of use and the General Terms and Conditions.
  • To be of legal age and to have the legal capacity required to access the Xerpa Mobility websites.
  • To treat the identity and password obtained upon registration as a client in a confidential and responsible manner.

Once the booking has been made, the user will see the booking confirmation on screen. The booking confirmation and receipt shall not be valid as an invoice.

General booking terms

Important: XM acts as a booking agent. You enter into a service contract directly with the Provider and not with us. As Agent, we accept no liability for the provision of the transport service itself.

Our liability is limited to publishing information on our website about the Services offered by the Providers, transmitting booking information or modifications to Providers, and informing you of any changes applied to the terms of your booking.

We disclaim all liability for any losses that may result from incorrect processing of your request by the Provider, errors made by you in completing the booking form, or the failure to communicate complete and accurate information during the booking process.

Luggage

Each passenger may carry one piece of luggage with a maximum weight of 20 kg (maximum combined total dimensions of 158 cm — length + width + depth). Luggage must be labelled with your name, destination address and telephone number.

Neither the Provider nor XM shall be liable for any loss or damage suffered by your luggage. Responsibility for your luggage rests with you. We recommend that you take out an insurance policy to protect yourself against possible loss and damage.

Minors and child restraint systems

During the service request process you must inform us if you are travelling with minors. Safety regulations in this regard vary by country; you must therefore request, at the time of booking, that the appropriate child restraint system be provided in accordance with applicable regulations.

Pets

During the booking process you must inform us if you are travelling with pets. Pets are your sole responsibility. They must always travel in a carrier that complies with applicable regulations. The transport of pets is subject to the availability and approval of the Provider and an additional charge.

Conduct and prohibitions

XM and the Provider reserve the right to refuse transport to any person who is under the influence of alcohol or drugs. The consumption of alcohol and narcotic substances is strictly prohibited in the vehicles. Smoking inside the vehicles is not permitted.

Waiting time

Once your flight has landed (or your train has arrived at the station), the Provider will wait for you for 30 minutes at the meeting point indicated on your booking voucher. If after 30 minutes the client has not appeared at the designated meeting point, the service will be cancelled without entitlement to a refund.

The client declares that they are of legal age and have the capacity to accept the responsibilities undertaken.

b)

The client declares that they understand the general terms and conditions and undertakes to pay for the requested services using a valid credit or debit card.

c)

The client must notify XM of any change affecting their booking and the service as quickly as possible.

d)

The service will be carried out in accordance with the details provided during the booking process. All details appearing on the booking voucher must be checked and any discrepancies notified at least 2 hours in advance.

e)

The client must carry all documentation required to cross borders. The booking voucher is not considered a valid document for obtaining visas.

f)

In the event that XM or the Provider should incur any deposit or fine due to the client's failure to comply with applicable laws, we shall have the right to retain any amount of money belonging to you until full payment has been made.

Additional services

During your service request process, Xerpa Mobility offers you the option of requesting additional services:

Baby seat
Child booster seats
Additional luggage
Ski or golf equipment transport
Other special services

Payment for these additional services is merely a provision and does not guarantee their availability on the day of the transfer. In the exceptional event that the Provider is unable to fulfil the extra service request on the day of the transfer, the client must notify us directly and the amount paid for that extra service for that transfer will be fully refunded.

Booking process

XM provides information about all available bookings, their characteristics and prices. However, XM reserves the right to withdraw, replenish or change the offers provided to clients through its website.

Booking request

Complete the booking form entering all required details (names, addresses, telephone numbers, dates and times). It is extremely important that you verify all details are correct.

Payment

No service request will be processed without the corresponding payment. Immediately after successful payment, we will send you a receipt by email.

Booking confirmation

Once the Provider has confirmed your booking, we will send you an email with the booking voucher. This will formally constitute the binding contract between you and the Provider.

Voucher review

When you receive the booking voucher, review it carefully and ensure that all details are correct. If you notice any error, please notify us immediately.

Modifications

Any request to change your booking must be sent by email at least 2 hours in advance. No change will take effect until we receive it and confirm it to you by email.

The Provider will monitor the arrival of your flight or train to account for possible schedule changes. However, if your flight or train number changes, or you miss your flight/train, you must notify us by calling the 24-hour assistance number shown on your booking voucher.

Payment terms

The client may pay the amount due for their order using any of the following methods:

VISA or MASTERCARD

All transactions involving the transmission of personal or banking data are carried out using a secure environment, a server based on the standard SSL (Secure Sockets Layer) security technology. All information transmitted to us travels encrypted over the network.

Cash in the vehicle

You may also pay for the service directly in cash to the driver at the time of the transfer. In this case, payment is made at the end of the service and the amount to be paid is that shown on the confirmed booking voucher. The driver will provide you with the corresponding receipt.

Your credit card details are entered directly on the bank's page, at the POS (Bank Point of Sale Terminal) and are not entered or stored on any Xerpa Mobility server.

In the case of cash payment in the vehicle, the refund for advance cancellation is not applicable, as payment is collected at the time of the transfer. For any issues related to cash payment, please contact our customer service team.

When paying by VISA or MASTERCARD you will always be asked for: the card number, the expiry date, and a Validation Code corresponding to the last three digits of the number printed in italics on the reverse of your card.

If an amount has been fraudulently or incorrectly charged to a purchase, the cardholder may request the immediate cancellation of the charge.

Cancellation and refunds

Cancellation with refund

Cancellation sent by email at least 2 hours before the scheduled time of the first transfer. A full refund will be issued using the same payment method and currency used.

Cancellation without refund

Cancellations made less than 2 hours before the scheduled pick-up time will NOT be eligible for a refund.

Any cancellation request for a booking must be sent by email to the Xerpa Mobility contact address at least 2 hours before the scheduled time of the first transfer.

Force majeure: Neither XM nor the Provider can guarantee or accept liability for extraordinary circumstances that may occur prior to your transfer: accidents, police checks, acts of vandalism or terrorism, natural disasters, fires, adverse weather conditions or other similar events beyond the Provider's control.

Data protection and user rights

In accordance with applicable and current data protection regulations, XM informs users that the personal data collected during the registration and/or booking process will be incorporated into the data processing system owned by Xerpa Mobility SL, for the purpose of processing these actions by the user and managing subsequent actions arising therefrom.

Your data will be retained for the period strictly necessary to fulfil the purposes set out above, unless there is a legal obligation to retain them for longer.

The legal basis for processing your data is the proper performance of the contract between the parties and your consent.

In accordance with the rights conferred on you by applicable data protection regulations, you may exercise your rights of access, rectification, restriction of processing, erasure, portability and objection to the processing of your personal data by sending your request to the postal address or email address indicated in this document.

Access

Obtain information about your data and the processing carried out.

Rectification

Correct data that is inaccurate or incomplete.

Restriction

Limit the originally planned purposes of the processing.

Erasure

Have your personal data erased, except where retention is required by law.

Portability

Receive your data in a structured format and transmit it to another controller.

Objection

Request that the processing of your data be discontinued.

You may contact the competent supervisory authority in the Principality of Andorra to lodge any complaint you consider appropriate: Andorran Data Protection Authority (APDA).

XM reserves the right to bring such civil or criminal actions as it deems appropriate for improper use of its website and content or for breach of these terms and conditions. The relationship between the user and XM shall be governed by the regulations in force and applicable in the Principality of Andorra.
